WHAT IS A CONDOMINIUM JURISTIC PERSON (OR CJP)?

Condominiums offer various shared facilities like swimming pools, gyms, and communal areas, which are co-owned by all owners. Condominium owners have a fractional ownership share in all of the condo’s common areas and facilities. But who takes care of these shared spaces? The answer is the Condominium Juristic Person, also known as CJP.

What is a Juristic Person?
In Thailand, a group of individuals recognized by law as being entitled to specific legal rights and/or duties is referred to as a Juristic Person. This includes the management company and the owners committee, collectively known as the Condominium Juristic Person, responsible for managing the condominium resort on behalf of all owners.

Who is a Juristic Manager?
The CJP may act as the manager of the condominium, or they may appoint someone to act as a manager. If the CJP appoints a company, the company must appoint an individual to act as the Juristic Manager (CJM), who carries out all administrative or maintenance duties, including signing relevant paperwork and cheques.

Rights and Duties of Juristic Persons
The “rights” of a Juristic Person would be to act on behalf of all owners to perform their “duties,” which include managing the resort, collecting common area fees from owners, employing and paying workers, paying utility bills, garbage disposal, and ensuring the facilities and gardens are well-maintained.
